A Ogden man convicted of raping two women has filed a motion to delay sentencing. The state did not contest the continuance, setting a new sentencing for Oct. 5.
Defense attorney Cole Hawver requested the later date because he and the defendant, Charles McMullen, 55, are waiting for additional documentation.
State prosecutor Michael Blackburn and Hawver agreed that the sentencing should only proceed for an hour. Prior to the record, Hawver told Judge Grant Bannister that he “anticipates” victims wanting to address the court.
McMullen is guilty of two counts of rape and two counts of aggravated sexual battery between two separate crimes.
Officers first arrested McMullen on Sept. 16, 2022 for raping a 58-year-old woman on Sept. 2, 2022. The second crime involved rape and the two counts of aggravated sexual battery when he committed acts against a 51-year-old woman on July 5, 2022. Police said both victims knew McMullen during the offenses.
Blackburn said “it’s fine” to reschedule the sentence, but he will ask the court to proceed with the sentencing if files are obtained by the defense team by Oct. 5.
